In order to implement the necessary measures to protect human health and the environment, a legal or natural person who places a chemical on the market as a manufacturer or importer must provide a safety data sheet in accordance with the Chemicals Act and forward it to the Chemicals Office.
The Chemicals Act (Official Gazette of the Republic of Slovenia, No. 110/03 – official consolidated text, 47/04 – ZdZPZ, 61/06 – ZBioP, 16/08, 9/11 and 83/12 – ZFfS-1) states:
Article 35 (communication of data on chemicals and dangerous products)
Legal and natural persons who produce a hazardous chemicals in the Republic of Slovenia or introduce/import a hazardous chemical into the Republic of Slovenia must submit:
- data from the safety data sheet,
- chemical composition, and
- information on areas of application,
for each hazardous chemical and for each hazardous product.
The data from the safety data sheet must be submitted to the body responsible for chemicals no later than the first release of a dangerous chemical to a third party or the first introduction of a dangerous chemical into the Republic of Slovenia.
The chemical composition of the dangerous chemical and data on areas of application must be submitted no later than 31 March of the year following the first release to the third party or first entry/import.
Which means you have to have a safety data sheet for each of your chemicals or chemical products before you can register and import/sell them.

TITLE IV
INFORMATION IN THE SUPPLY CHAIN
Article 31 (Requirements for safety data sheets)
1. The supplier of a substance or a mixture shall provide the recipient of the substance or mixture with a safety data sheet compiled in accordance with Annex II:
(a) where a substance meets the criteria for classification as hazardous in accordance with Regulation (EC) No 1272/2008 or a mixture meets the criteria for classification as dangerous in accordance with Directive 1999/45/EC; or
(b) where a substance is persistent, bioaccumulative and toxic or very persistent and very bioaccumulative in accordance with the criteria set out in Annex XIII; or
(c) where a substance is included in the list established in accordance with Article 59(1) for reasons other than those referred to in points (a) and (b).
2. Any actor in the supply chain who is required, under Articles 14 or 37, to carry out a chemical safety assessment for a substance shall ensure that the information in the safety data sheet is consistent with the information in this assessment. If the safety data sheet is developed for a mixture and the actor in the supply chain has prepared a chemical safety assessment for that mixture, it is sufficient if the information in the safety data sheet is consistent with the chemical safety report for the mixture instead of with the chemical safety report for each substance in the mixture.
3. The supplier shall provide the recipient at his request with a safety data sheet compiled in accordance with Annex II, where a mixture does not meet the criteria for classification as dangerous in accordance with Articles 5, 6 and 7 of Directive 1999/45/EC, but contains:
(a) in an individual concentration of ≥ 1 % by weight for non-gaseous mixtures and ≥ 0,2 % by volume for gaseous mixtures at least one substance posing human health or environmental hazards; or
(b) in an individual concentration of ≥ 0,1 % by weight for non-gaseous mixtures at least one substance that is persistent, bioaccumulative and toxic or very persistent and very bioaccumulative in accordance with the criteria set out in Annex XIII or has been included for reasons other than those referred to in point (a) in the list established in accordance with Article 59(1); or
(c) a substance for which there are Community workplace exposure limits.
4. The safety data sheet need not be supplied where substances that are hazardous in accordance with Regulation (EC) No 1272/2008 or mixtures that are dangerous in accordance with Directive 1999/45/EC, offered or sold to the general public, are provided with sufficient information to enable users to take the necessary measures as regards the protection of human health, safety and the environment, unless requested by a downstream user or distributor.
Important
In short, if your import dangerous chemicals to Slovenia, YOU are responsible for safety data sheet and not the manufacturer. Safety data sheets and their compliance with all regulations are regularly checked by the Chemicals Office, so choose your Chemical Advisor carefully.
